You control what you host and must have authority to host it. Protect the owner key. NodePier may stop harmful, unlawful, insecure, or resource-abusive services. The platform is provided as available, with no uptime guarantee.
1. Agreement and operator
These Terms of Service (the “Terms”) are an agreement between the person or organization using NodePier (“you”) and NodePier, an independently operated, invitation-only service based in Fairfax, Virginia (“NodePier,” “we,” “us,” or “our”). By accessing the owner console, using the API, uploading content, or operating a hosted site, you accept these Terms and the policies incorporated below.
You must be at least 18 years old and legally capable of entering this agreement. If you use NodePier for an organization, you represent that you are authorized to bind it. The service is not offered to anyone barred from using it under applicable law.
2. The service
NodePier provides tools for deploying static content and isolated applications, managing site lifecycle actions, routing NodePier subdomains and custom domains, obtaining and renewing TLS certificates, viewing privacy-preserving operational totals, and optionally exposing eligible applications as Tor onion services.
Access is invitation only. Invitations are personal, non-transferable, revocable, and do not guarantee continued access. Features may be added, changed, limited, or removed. Limits may apply to storage, bandwidth, CPU, memory, build time, ports, connections, requests, logs, domains, and other resources. A feature's presence in the interface or API is not a promise that it will always be available.
If charges are introduced or separately agreed, applicable prices, taxes, billing periods, and payment terms will be disclosed before they apply. Unless a separate written order says otherwise, these Terms control.
3. Owner key and account security
NodePier uses one authorized public key to control deployments. You are responsible for protecting the corresponding private key, devices, sessions, recovery material, and optional authenticator secret. The private key should never be shared with NodePier or another person.
- Actions carrying a valid owner-key signature are treated as authorized by you unless NodePier has accepted notice of compromise.
- Optional two-factor authentication provides an additional check but does not replace private-key security.
- Loss of the only authorized private key may make the service inaccessible. Recovery or key replacement is not guaranteed.
- You must promptly report suspected compromise through the contact method below.
4. Your content, applications, and domains
You retain ownership of content you upload. You grant NodePier a limited, worldwide, non-exclusive license to store, copy, build, run, route, transmit, and display that content only as reasonably needed to provide, secure, maintain, and troubleshoot the service or comply with law.
You are responsible for your sites, application code, dependencies, databases, user submissions, privacy notices, licenses, backups, and legal compliance. NodePier's infrastructure isolation does not make unsafe code safe and does not transfer responsibility for an application's behavior to NodePier.
For every custom domain, hostname, certificate request, or onion service you configure, you represent that you have the right and authorization to use it. NodePier may not technically verify domain ownership before attempting routing or certificate issuance; that does not grant you rights in another person's domain or name.
NodePier does not create backups of customer content. The deployment system may temporarily retain the current release and up to two previous releases, plus container images or build artifacts, solely to operate deployments. These service copies are not a backup or recovery promise and may be deleted or become unavailable at any time. You must maintain independent copies of all important content and application data.
5. Acceptable use and third-party terms
You must follow the Acceptable Use Policy. You may not use NodePier to violate law, others' rights, network rules, certificate-authority requirements, domain-provider rules, or upstream infrastructure terms. Open-source software and third-party services remain governed by their own licenses and terms.
You are responsible for people, agents, scripts, and applications acting with your key or through your hosted services. You may not bypass resource controls, isolation, security restrictions, or lifecycle safeguards.
6. Suspension, removal, and termination
You may stop or permanently remove a site using the console or API. Removal is intended to delete the selected live project and its managed resources, but you should retain your own copy before acting.
NodePier may throttle, isolate, stop, suspend, refuse, or remove content or services when reasonably believed necessary to:
- address an actual or suspected security incident, attack, vulnerability, or infrastructure risk;
- enforce these Terms or the Acceptable Use Policy;
- respond to valid legal process or credible rights complaints;
- protect NodePier, its upstream providers, other networks, or the public;
- prevent excessive or unpaid resource consumption; or
- perform maintenance or discontinue the service.
Where practical and safe, NodePier may provide notice and an opportunity to correct a problem. Immediate action may be taken without notice for urgent risk. NodePier is not obligated to preserve suspended or removed content.
7. No uptime commitment; disclaimers
NodePier provides no service-level agreement and makes no guarantee of uptime, availability, latency, support response time, data durability, certificate issuance, DNS propagation, build success, Tor reachability, or error-free operation. No service credits are offered.
The Service Availability Policy is incorporated into these Terms.
To the maximum extent permitted by law, the service is provided “as is” and “as available.” NodePier disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, and warranties arising from course of dealing or usage of trade. NodePier does not warrant that the service will meet your requirements or that content or data will be secure from every threat or recoverable after loss.
Some jurisdictions do not allow certain disclaimers. In that event, a disclaimer applies only to the maximum extent permitted.
8. Limitation of liability and indemnity
To the maximum extent permitted by law, NodePier and its operator, suppliers, and personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, goodwill, use, or data; business interruption; replacement services; or claims arising from content, security incidents, outages, suspension, domain or certificate failures, or third-party services—even if advised that such damage is possible.
NodePier's aggregate liability arising from or related to the service will not exceed the greater of (a) the amount you paid NodePier for the service during the twelve months before the event giving rise to the claim or (b) US $100. This cap does not apply where applicable law prohibits it.
You will defend, indemnify, and hold harmless NodePier and its operator and personnel from third-party claims, losses, and reasonable costs arising from your content, applications, domains, users, violation of these Terms, or infringement of another person's rights, except to the extent caused by NodePier's own conduct for which indemnity cannot lawfully be required.
9. General terms
Privacy
The Privacy Policy explains NodePier's data practices. Your hosted application's collection and use of data is your responsibility and must be covered by your own appropriate notice.
Changes
NodePier may update these Terms prospectively. Material changes will be identified by a new effective date and, when reasonably possible, notice through the service. Continued use after the effective date constitutes acceptance. Materially expanded data use will not be applied retroactively merely by changing this document.
Governing law and venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. The state courts located in Fairfax County, Virginia, and the federal courts serving Fairfax County will have exclusive jurisdiction, except where mandatory law provides otherwise.
Entire agreement and severability
These Terms and incorporated policies are the entire agreement about the service unless a signed writing says otherwise. If one provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not transfer this agreement without consent; NodePier may transfer it with the service or operator.
